COPYRIGHT INFORMATION
All of the greeting card(s) on this website are . By purchasing any of the greeting card(s) from our shop, you acknowledge and agree to be bound by the terms and conditions laid out within this document.
This EULA is a legal agreement between yourself (the End User) and SallieAmoreGreetings.com. In this Agreement, the party who owns the media will be referred to as “SallieAmoreGreetings.com”, and the party who purchases the media will be referred to as “End User”. Before placing an order on our website, you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any of our greeting card(s).
Anyone found breaching this agreement will be subject to criminal and civil penalties and liable for monetary damages. Please respect our work.
GRANT OF LICENSE
Upon purchasing a greeting card(s) from our shop, we grant the End User license to use the greeting card(s) in accordance with the terms and conditions laid out in this Agreement.
RIGHTS GRANTED
a) End User may use the greeting card(s) to keep, hold, send, give, mail to recepient.
b) End User may use the greeting card(s) for personal personal use. No commercial, copying, redistribution for profit, credit, or ownership is conveyed to the End User.
c) End User may use the greeting card(s) for the only for the purposes intended for the greeting card(s).
COPYRIGHT
All right, title and interest in the greeting card(s) on our website, in stores, printed, or otherwise is and shall always remain the property of SallieAmoreGreetings.com. No ownership rights to the images or art or text within the greetings are granted, transferable, or implied. All rights not expressly granted to you hereunder are reserved by SallieAmoreGreetings.com.
INDEMNITY
End User hereby indemnifies SallieAmoreGreetings.com from, and against any and all claims, demands, suits, actions, causes of action, damages, liabilities, charges and expenses, including attorneys fees incurred by SallieAmoreGreetings.com with respect to any matter that arises as a result of any claim that the copyrighted greeting card(s) infringe or violate any rights of any third party or any breach of this agreement by you.
WARRANTY
SallieAmoreGreetings.com warrants that it has full authority to license and distribute all of the greeting card(s) on our website under the terms of this agreement.
LIABILITY
SallieAmoreGreetings.com shall not be liable for any loss of business or business profits, business interruption, or any other form of direct or indirect loss resulting directly or indirectly from the use of any of the copyrighted greeting card(s).
RESTRICTIONS
a) End User may not modify any of the greeting card(s) with intent to claim authorship.
b) End User may not sell any of the greeting card(s) or contents of any of the greeting card(s) for the purposes of commercial gain.
c) End User may not transfer, duplicate, assign, share, resell for profit, sub-lease, or claim ownership of the copyrighted greeting card(s) or imply such claim with any other party.
e) NO AI TRAINING PERMITTED. Any intangible asset copyrighted from SallieAmoreGreetings.coms may only be used as intended and may not be utilized or “scrubbed” to train or otherwise develop any algorithm, machine learning (AI), neural network and/or artificial intelligence in any manner.
f) Unless proven otherwise, it will be assumed that the damages caused by any unauthorized use will amount to the sales price as a multiple of the number of people reached by the unauthorized use.
g) The SallieAmoreGreetings.com retains a right to investigate the use of its copyrighted properties.
ASSIGNMENT
End User may not assign, sell, license or sub-license the copyrighted greeting card(s) to any other party without SallieAmoreGreetings.com’s written consent.
TERMINATION
The End User’s right to use any of the greeting card(s) from SallieAmoreGreetings.com will automatically terminate in the event of any breach by End User of the terms of this Agreement and upon written demand from SallieAmoreGreetings.com, End User agrees that End User shall immediately destroy all copies of SallieAmoreGreetings.com’s greeting card(s) in the End User‘s possession or control.
JURISDICTION
These Terms are to be governed by and interpreted according to United States law. This means a Contract for the purchase of greeting card(s) through our website, and any dispute or claim arising out of or in connection with it or these Terms will be governed by United States law. All disputes arising under them will be subject to the exclusive jurisdiction of the United States courts.
Any claims made against SallieAmoreGreetings.com or it’s owner(s) must filed in United States Courts for the district of Massachusetts.
SEVERABILITY
This is a binding legal agreement between you (the End User), and us (the SallieAmoreGreetings.com). By purchasing and using any of the greeting card(s) from our website constitutes the acceptance of these terms. Each of the paragraphs of these Terms operates separately. If any determines that any clause within this EULA is unlawful, the remaining clasues will remain in full force and effect.
